Kentucky has taken a decisive step forward to strengthen their drunk driving and DUI law with an “all-offender” Ignition Interlock requirement. The law, which takes effect on July 1, 2020, will require first-time DUI cases to use an Ignition Interlock Device in Kentucky.

Before this bill, only repeat DUI cases and high-BrAC, first-time DUI cases were required to install and use an Ignition Interlock for a specified period. A high BrAC level is typically .15 or greater with .08 being the legal limit in all states except Utah.

The KY Transportation Cabinet oversees the Ignition Interlock program and assists drivers with their reinstatement process.

Highlights of Kentucky’s New IID Law

When the court revokes a person’s license for a DUI, any license the person shall be issued will restrict the person to operating only a motor vehicle or motorcycle equipped with a functioning Ignition Interlock Device.

  • First DUI: a functioning Ignition Interlock Device shall be installed for a period of six (6) months.
  • Second DUI in a 10-year period: A functioning Ignition Interlock Device shall be installed for a period of twelve (12) months.
  • Third or subsequent DUI in a 10-year period: A functioning Ignition Interlock Device shall be installed for a period of thirty (30) months.

The 10-year period shall be measured from the dates on which the offenses occurred for which the judgments of conviction were entered, resulting in the license revocations.
