Any discussion of Ignition Interlock requirements in New York has to include Leandra’s Law. It was passed in 2010 in memory of Leandra Rosado, an 11-year old who was killed riding in a car driven by an intoxicated driver.

An IID can be installed upon arrest from a first or second offense. The usual period with the device is a year, unless otherwise permitted by the court. New York allows individuals to obtain credit for time with an IID before sentencing.

In addition, a court must sentence a person convicted of either Aggravated DWI/Child in Vehicle or Aggravated DWI/Driving with a Blood Alcohol Content (BAC) of .18 or more to a period of probation or conditional discharge. Then, the court will require an IID on any motor vehicle this person owns or operates.

In most cases, your IID must be installed 10 days from receiving your court order. Or, if you are imprisoned for your DWI offense, you must install the IID within 10 days of being released from prison.
